1. Acceptance of Terms
By accessing or using CoCreatea (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Platform.
CoCreatea is operated from India and is available to users worldwide. These Terms constitute a legally binding agreement between you and CoCreatea.
2. Eligibility
- You must be at least 13 years old to use CoCreatea.
- If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have the consent of a parent or legal guardian.
- By creating an account, you represent that you meet these eligibility requirements.
3. Account Registration
To use most features of CoCreatea, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials.
- Notify us immediately if you suspect unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
4. Acceptable Use
You agree not to use CoCreatea to:
- Post or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Upload content that infringes on any third party's intellectual property rights, including copyrights, trademarks, or patents.
- Impersonate any person or entity, or falsely represent your affiliation with a person or entity.
- Engage in spam, scams, phishing, or any form of deceptive activity.
- Attempt to gain unauthorized access to other users' accounts or any part of the Platform's infrastructure.
- Use automated tools, bots, or scraping mechanisms without our written permission.
- Distribute malware, viruses, or any other harmful code.
- Interfere with or disrupt the Platform's services, servers, or networks.
5. User Content
A. Ownership
You retain ownership of all content you post on CoCreatea, including audio tracks, videos, images, text, and other creative works (“User Content”).
B. License to CoCreatea
By uploading User Content, you grant CoCreatea a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely for the purpose of operating and improving the Platform. This license ends when you delete your content or your account.
C. Content Moderation
We reserve the right to review, remove, or restrict access to any User Content that violates these Terms or our community guidelines. We may use both automated tools and human review for content moderation.
6. Collaborations
CoCreatea facilitates connections between artists for collaborative projects. However:
- CoCreatea is not a party to any collaboration agreement between users.
- We do not guarantee the quality, outcome, or completion of any collaboration.
- Users are solely responsible for negotiating terms, rights splits, credits, and payments for collaborative works.
- We strongly recommend documenting collaboration terms in writing between parties.
7. Intellectual Property
The CoCreatea platform, including its design, logos, features, and underlying technology, is owned by CoCreatea and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.
8. Privacy
Your use of CoCreatea is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described therein.
9. Account Suspension & Termination
We may suspend or terminate your account if:
- You violate these Terms or our community guidelines.
- Your account is flagged by our fraud detection system for suspicious activity.
- You engage in behavior that is harmful to other users or the Platform.
If your account is suspended due to automated fraud detection, you have the right to request human review by contacting tech-support@cocreatea.com.
You may delete your account at any time from your profile settings. Upon deletion, all your data is permanently removed within 5 minutes as described in our Privacy Policy.
10. Disclaimers
CoCreatea is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- The Platform will be uninterrupted, secure, or error-free.
- Any collaboration initiated through the Platform will be successful.
- User Content is accurate, complete, or reliable.
11. Limitation of Liability
To the maximum extent permitted by applicable law, CoCreatea shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.
12. Indemnification
You agree to indemnify and hold harmless CoCreatea, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising out of your use of the Platform, your User Content, or your violation of these Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of CoCreatea shall be subject to the exclusive jurisdiction of the courts in India.
For EU users, this does not affect your rights under mandatory consumer protection laws of your country of residence.
14. Changes to These Terms
We may update these Terms from time to time. When significant changes are made, we will notify you via email or a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of CoCreatea after the updated Terms are posted constitutes acceptance of the new Terms.
